Robert N. Hocker’s practice has been limited to civil litigation and jury trials for over 20 years. Bob has achieved the AV Preeminent® Rating – the Highest Possible Rating from Martindale-Hubbell®.
Bob was born, raised and educated is northern California. He came to San Diego in 1992 to serve a judicial clerkship. After completing his clerkship, Bob was recruited by a prominent San Diego law firm, McInnis, Fitzgerald, Rees & Sharkey. In 1999, the McInnis firm was purchased by one of San Diego’s oldest and most respected firms, Higgs, Fletcher & Mack, where Bob became a partner. In 2003, Bob started his own firm and, in 2012, was joined by Will Browning, a friend and fellow member of the McInnis firm.
The vast majority of litigated cases settle before trial. Bob firmly believes that being represented by an attorney who has a proven record of success at trial allows clients to negotiate from a position of confidence and strength. Most litigators practicing today have very little, if any, real trial experience. In contrast, Bob has successfully tried to verdict a wide variety of civil matters. Most of Bob’s cases are referred to him by fellow lawyers who have worked with him and know his trial skills and his commitment to clients.
The following is a list, in alphabetical order, of the areas in which Bob has significant experience:
Business Litigation: Bob has litigated and tried a diverse range of business disputes including cases involving claims for breech of contract, tortuous interference with contract, unfair competition, fraud, partnership disputes, and breach of fiduciary duty.
Employment Litigation: Bob has substantial experience in employment litigation and has represented both plaintiffs and defendants through trial in the areas wrongful termination, employment discrimination /retaliation, wage & hour, and unfair competition/trade secret.
Legal Malpractice: Earlier in his career, Bob defended attorneys, now he limits this area of his practice to representing plaintiffs in select legal malpractice matters. Since starting his own firm, legal malpractice has become a significant part of Bob’s practice.
Personal Injury: Bob has handled a large number of personal injury cases including a number of civil jury trials to verdict. He currently handles only a select number of personal injury cases.
Public Entity: Since 1994, Bob has handled hundreds of claims against public entities and is well versed in this area of the law. Bob has litigated through trial an array of public entity cases in the areas of civil rights, employment, construction, personal injury and special education.
Real Estate & Construction Litigation: Bob has represented owners/developers, both private and public, in litigation through trial and binding arbitration. These cases have included multi-million dollar construction delay, breach of contract and change order cases. On the real estate side, Bob has handled a number of matters, large and small, including litigation arising from multi-million dollar commercial real estate transactions.
